Terms of Service

Welcome to ZMetcha ("the Service"), operated by ZMETCHA LLC, an Arizona limited liability company ("Company," "we," "us," or "our"). By creating an account or using our Service, you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Community Guidelines, all of which are incorporated into these Terms by reference.

If you do not agree to these Terms, do not use the Service.

Operator Participation Disclosure

ZMetcha is operated by ZMETCHA LLC. Platform owners, operators, administrators, and staff ("Operators") may also use the Service as regular users. When they do, they are bound by these same Terms and Community Guidelines. Operator administrative access to user data (including messages, photos, and profiles) is technically restricted from users they have interacted with on their personal dating profile (matched, messaged, or swiped), and all administrative actions are logged in an audit trail that Operators cannot silently disable. Operator accounts are separately maintained from any dating profile they may use as a user.

Limited Administrative Access. Administrative access to user data is limited to what is necessary for safety, moderation, and operational purposes and is subject to internal controls and restrictions. Operators do not have unrestricted or ambient access to user content and cannot use administrative tools to browse, search, or surveil users outside the scope of a documented operational task.

No Use for Personal Advantage. Administrative access is not used for personal, dating, romantic, sexual, social, or any other non-operational purpose. Operators are prohibited from using admin tools to gain advantage on the dating side of the Service, to view profiles or content of users they are romantically or sexually interested in, or to influence matching, visibility, or moderation outcomes for themselves or anyone acting on their behalf. Violations by an Operator are grounds for immediate removal, loss of administrative access, and where applicable, referral to appropriate authorities.

1. Eligibility

To use ZMetcha, you must:

  • Be at least 18 years of age. We verify age through government-issued ID and selfie verification.
  • Not be a person who is barred from using the Service under the laws of the United States or any other applicable jurisdiction.
  • Not have been previously banned from the Service.
  • Not be listed on any sex offender registry or have been convicted of a violent felony or sexual crime.
  • Be legally capable of forming a binding contract.
  • Not maintain more than one account at any time.

We reserve the right to request additional verification of your eligibility at any time. Providing false information about your age, identity, or eligibility is grounds for immediate termination.

Location information. We collect location information you provide (such as city and state) and may infer approximate location from your IP address when you log in. We request access to your device location (such as GPS) only for the purpose of verifying your profile location. If you grant browser location permission, we may use it to verify that your device location is consistent with the city and state on your profile. Users whose location is verified receive a Location Verified badge visible to other users. Location verification indicates that a user's device location matched or was consistent with their stated or approved profile locations at the time of a recent session. Verification may include automated and manual review. It does not guarantee a user's current location or real-time presence. This badge is reset if you change your profile location. Precise device coordinates are not stored long-term; only the verification result (verified or not) is retained. We log approximate login locations for safety and fraud prevention. Location mismatches may be used as part of our safety and fraud detection systems. If you change your profile location, you will be asked to select a reason (e.g., moved, traveling, work).

2. Account Registration and Verification

2a. Phone Verification & SMS Communications

You must verify your phone number via SMS to create an account. By providing your phone number and tapping "Send code," you provide your prior express written consent to receive automated text messages from ZMetcha for verification, security alerts, and service communications. This consent is not a condition of purchase.

  • Message frequency: verification codes are sent once per sign-in attempt. Service alerts are sent infrequently (estimated 1-5 messages per month).
  • Message and data rates may apply. Check with your carrier.
  • Opt-out: reply STOP to any message to unsubscribe from non-essential SMS. You may still receive security-critical messages (e.g., account compromise alerts). You can also opt out by emailing [email protected].
  • Help: reply HELP or contact [email protected] for assistance.
  • SMS services are provided through Telnyx. See our Privacy Policy for details on how your phone number is used.
  • SMS messages used for authentication or account security (such as one-time passcodes) are transactional and are not used for marketing purposes.
  • Carriers are not liable for delayed or undelivered messages.

2b. Identity Verification (Face & ID)

To help ensure the safety of our community, we require selfie verification and optionally government-issued photo ID verification. Selfie verification uses facial recognition technology (face-api.js) to compare your selfie against your profile photos. ID verification uses optical character recognition (Tesseract.js) to confirm your identity and age from your government-issued document.

Biometric Data Notice: During selfie verification, we extract facial geometry data from your selfie. This data is processed on our servers (not sent to any third-party facial recognition service) and used for two purposes: (a) verifying that your selfie matches your profile photos and government-issued ID, and (b) detecting and preventing fraudulent duplicate accounts (anti-sybil safety). For purpose (a), biometric identifiers are deleted within 30 days of verification. For purpose (b), a stored facial-geometry descriptor (a mathematical vector, not an image) is retained for the lifetime of your account to compare against new signups. Upon account deletion, all biometric data -- including the stored descriptor -- is permanently destroyed within 24 hours. We do not sell, lease, trade, or otherwise profit from your biometric data. Duplicate-account detection is a safety feature; a match generates a report reviewed by a human administrator and never results in an automatic ban. If you are a resident of Illinois, Texas, or Washington, you will be presented with a separate biometric consent form before we collect this data, as required by applicable state law.

2c. Background Check & Identity Verification (Optional)

Background check and identity verification are optional features. ZMetcha partners with Charisma Check, LLC as our third-party verification provider; identity components may also be performed by Stripe Identity or other providers Charisma uses. Detailed terms governing consent, FCRA-compliance restrictions on use of any report, accuracy disclaimers, badge display, fees, and dispute resolution are set out in our Background Check & Identity Verification Terms, which are incorporated by reference. Reports made available through the Verification Services are for personal informational use only and are not consumer reports under the FCRA.

  • Background checks are entirely voluntary and not required to use the Service.
  • If you pass, your profile shows a Verified Background badge for 12 months; after that the badge expires and you may re-verify if you wish.
  • We display only the pass/fail badge to other users. The result note we keep is brief and is for our records / dispute resolution; it is not displayed publicly.
  • A background-check badge does not guarantee a user's safety, character, or intentions. It only attests that a clean result was returned at the time of the check.
  • Under the FCRA you have the right to dispute the result of a check. Contact [email protected]and we will direct you to the provider's dispute process.
  • You can cancel a pending request in Settings at any time before the result is returned.

We do not conduct background checks on all users and do not guarantee the identity, character, or history of any user.

2d. Criminal Record Disclosure

Our Service also includes an optional criminal record self-disclosure feature for users seeking dating connections. Self-disclosures are voluntary, self-reported, and unverified. You should not rely on the absence or content of another user's criminal disclosure for your personal safety.

3. User Conduct and Community Standards

You agree not to:

  • Harass, bully, stalk, intimidate, threaten, or defame any person.
  • Post content that is hateful, discriminatory, violent, or promotes illegal activity.
  • Impersonate any person or entity, or misrepresent your identity, age, or affiliation.
  • Solicit money, goods, or services from other users.
  • Use the Service for commercial purposes.
  • Send unsolicited explicit content in messages.
  • Post child sexual abuse material (CSAM), non-consensual intimate imagery, or content depicting bestiality.
  • Use automated scripts, bots, or scrapers to access the Service or collect user data.
  • Attempt to reverse-engineer, decompile, or disassemble the Service.
  • Circumvent any security, verification, or content moderation measures.

The Service includes features for adult content within designated areas (e.g., intimate questionnaires, kink preferences). This content is restricted to users 18+ and must remain within those designated features. Our full content rules are described in our Community Guidelines.

Violations may result in warnings, temporary suspension, or permanent termination of your account at our sole discretion.

4. Content Ownership and Licensing

4a. Your Content

You retain ownership of all content you submit to the Service (photos, bios, questionnaire responses, messages). By submitting content, you grant us a worldwide, non-exclusive, transferable, sub-licensable, royalty-free license to use, display, reproduce, modify, and distribute your content for the purpose of operating, improving, and promoting the Service. This includes, without limitation: displaying your profile to other users, storing and delivering your messages, using your content for safety monitoring and content moderation, training moderation systems, and investigating violations of these Terms. This license ends when you delete your content or account, except where your content has been shared with other users and they have not deleted it, or where we are legally required to retain it.

4b. Other Users' Content

You may not copy, download, redistribute, sell, or commercially exploit any other user's content without their explicit written permission.

4c. Our Content

The Service's design, logos, user interface, algorithms, and proprietary technology are owned by us and protected by intellectual property laws. You may not use our trademarks or intellectual property without prior written consent.

5. Subscriptions and Purchases

ZMetcha offers free and premium subscription tiers. Premium subscriptions automatically renew at the end of each billing period unless cancelled. We will notify you in advance of any price changes.

  • Cancellation: you may cancel your subscription at any time through your account settings. Cancellation is as simple as subscribing - no phone calls or additional steps required, per FTC Negative Option Rule (16 CFR Part 425).
  • Confirmation: after subscribing, you will receive a confirmation email summarizing the subscription terms, recurring charge amount, and cancellation instructions.
  • Reminders: before each renewal, we will send a reminder notification at least 3 days in advance for monthly plans and 30 days in advance for annual/lifetime plans.
  • Refunds are handled in accordance with applicable law and the policies of our payment processor.
  • Subscription fees and any bundled in-app allowances (see §5b) are non-refundable except where required by law and constitute a limited license to use platform features, not property.
  • Arizona residents: you have a 3-day right of cancellation for subscriptions under ARS 44-1735.
  • California residents: auto-renewal terms comply with CA Business & Professions Code 17600 et seq. You may cancel at any time and receive a pro-rata refund.
  • New York residents: auto-renewal terms comply with GBL 527-a. Clear and conspicuous disclosure is provided before purchase.
  • Illinois residents: auto-renewal terms comply with the Illinois Automatic Renewal Act (815 ILCS 601).

5b. Bundled In-App Allowances

ZMetcha does not sell credits, tokens, or one-time consumable packs separately. Active subscribers receive a monthly allowance of in-app actions (such as Supercharge profile boosts, Super Sparks, message highlights, and profile pins) included with their subscription. Allowances refresh at the start of each billing cycle and any unused balance does not carry over.

  • Allowance units have no cash value and cannot be exchanged, transferred, sold, or redeemed for currency.
  • Allowance units are non-refundable and constitute a limited license to use platform features, not property or stored value.
  • Unused units expire at the end of each billing cycle and do not roll over.
  • If your subscription lapses, any remaining balance is forfeited; reactivating your subscription resets the allowance to the new period's grant.
  • ZMetcha reserves the right to modify allowance amounts, feature availability, and feature costs on reasonable advance notice.

5c. Photo Visibility Tiers

You control who sees each of your photos by assigning a visibility tier:

  • Public - visible to all users in the Spark feed and on your profile.
  • Matches Only - visible only to users you have mutually matched with.
  • Subscribers Only - visible only to paid subscribers you have mutually matched with.
  • Private - visible only to you. Matched users may request a reveal subject to a limited per-match allowance.

ZMetcha does not guarantee that visibility settings prevent all unauthorized access. Screenshots, screen recordings, and other capture methods are outside our control. We do not guarantee that content shared with other users will remain private once accessed. You upload content at your own risk.

5d. NSFW Content

You may tag photos as NSFW (Not Safe For Work) to indicate explicit or intimate content. NSFW-tagged photos:

  • Cannot be set to Public visibility - they are restricted to Matches Only, Subscribers Only, or Private.
  • Are displayed with a blur overlay. Recipients must actively tap to reveal the content, confirming their consent to view.
  • Must comply with all applicable laws. Content depicting minors, non-consensual acts, or illegal activity is strictly prohibited and will result in immediate termination and reporting to authorities.
  • You represent and warrant that you have the legal right to share any NSFW content you upload, including that all depicted persons are 18+ and have consented.
  • Users must obtain and maintain explicit consent for any NSFW content shared, and such consent may be withdrawn at any time.
  • We do not monitor all content and cannot guarantee that users will comply with these rules.
  • Users are solely responsible for the content they share and any consequences arising from it.

5e. Priority Messages

Priority messages are a subscriber feature that places your message in a recipient's featured inbox (limited to 5 slots). The recipient may accept or decline. If declined, you cannot send another priority message to that user. Allowance units spent on priority messages are non-refundable regardless of whether the recipient accepts or declines.Delivery or visibility of priority messages is not guaranteed.

5f. Search and Findability

ZMetcha includes an optional Search feature that allows users to look up other accounts by name, phone number, or email address. You control whether your account can be discovered through Search by toggling the corresponding settings in your privacy controls ("Findable by Name," "Findable by Phone Number," and "Findable by Email Address"). At signup, all three toggles default to enabled. You may disable any or all of them at any time, and changes take effect immediately for new searches.

  • What is exposed. When another user finds you through Search, they see the same public profile information they would see in the swipe feed (display name, age, photos that you have set to Public visibility, and any public profile content).
  • What is not exposed. Search does not reveal your phone number, email address, or any private profile content to the searcher. Search results never confirm whether a queried phone or email belongs to a ZMetcha account unless the account owner has Findability enabled for that channel.
  • Defaults and consent. You acknowledge and agree that, by creating an account with a phone number and email address, your account is discoverable via those channels by default until you choose to disable Findability. You may opt out at any time from your settings.
  • Findability does not affect any matches, conversations, or interactions you already have. It only governs whether new users can locate you through Search.

5g. Prompts and Public Responses

ZMetcha may display a daily prompt question ("Prompt of the Day") that any user may answer.

  • Public visibility. Responses you submit to a Prompt of the Day are visible to all other users of the Service, not only your matches. Treat each response the same way you would treat a public social media post.
  • Reactions. Other users may react to your response. Aggregate reaction counts are visible; the identity of each reactor is not exposed to the responder under the current implementation, but we may change this behavior in the future and will notify users in advance of any change that exposes reactor identity.
  • Deletion and retention. You may delete your own response to any prompt at any time by clearing your submission. We retain undeleted responses indefinitely so that the prompt thread remains coherent for other participants. After account deletion, your prompt responses are deleted in accordance with our Privacy Policy.
  • Content rules. Prompt responses are user-generated content and are subject to our Community Guidelines and the conduct provisions in §3 of these Terms. We reserve the right to remove responses that violate our policies.

5i. Safe Meetup

Safe Meetup is an optional feature that helps you stay safer when meeting another user (or anyone else) in person. You schedule a meetup with a venue, time, and a geofence radius; ZMetcha sends pre-meetup reminders and prompts you to check in when you arrive and again when you are safely home. If you do not check in within the windows you set, ZMetcha contacts the primary emergency contact you have configured.

  • Two modes. "Shared" meetups require a matched user on ZMetcha to consent before the meetup is active; both parties see each other's status and check-ins. "Solo" meetups are private to you and let you record any partner (matched or not) by free-form name.
  • Emergency contact. Escalation alerts only go to the primary emergency contact you have configured AND who has confirmed consent by replying YES to a verification SMS. Without that double-opt-in, no SMS is ever sent. Your emergency contact may opt out at any time by replying STOP. Other ZMetcha users (including a matched-meetup partner) never see who your emergency contact is.
  • Geolocation. Web-based check-ins are manual; you tap "I'm here" or "I'm safe." If you grant browser geolocation permission at check-in time, we may capture and store your coordinates so your record reflects where the check-in happened. The mobile app, when available, may also use background geofence triggers and a panic button for faster response. ZMetcha does not continuously track your location.
  • Calendar export. Adding a meetup to your calendar via Google / Apple / Outlook / .ics is a one-tap deep link or download; ZMetcha does not access your calendar account.
  • Auto-emit to Relationship Tracker. A successful "safe" check-in for a shared meetup will create an entry in your Relationship Tracker (see §5h) so the date is recorded automatically. Solo meetups with free-form partner names are not auto-emitted.
  • No guarantee of safety. Safe Meetup is a notification + audit tool, not a real-time security service. Reminders and escalation alerts may be delayed or fail to deliver. ZMetcha does not dispatch emergency services on your behalf and is not a substitute for calling 911 in an actual emergency. The full disclaimers in §9 apply.
  • Cancellation. Either participant in a shared meetup may cancel at any time. Once cancelled, no further reminders or escalations are sent for that meetup.

5h. Relationship Tracker

ZMetcha includes an optional Relationship Tracker feature that lets you privately log milestones with one or more partners (such as first message, first video call, anniversaries, and other events you choose to record).

  • User-side data. Tracker entries are stored on your side of the relationship. Adding a partner to your tracker does not create or modify any tracker on the partner's account, and the partner is not notified about your tracker entries unless they have separately enabled the same feature for the same relationship.
  • Auto-emitted milestones. If you opt in, the Service may automatically log certain milestones based on your activity with a tracked partner (for example, first exchanged message or first video call). You may disable auto-emit at any time and may delete any auto-emitted entry.
  • Deletion is one-sided. Deleting an entry from your tracker only affects your copy. If your partner has independently logged the same milestone on their own tracker, that copy is unaffected.
  • Tracker data is not shared with other users, used for matching, or shown on your public profile.

6. Health and Sensitive Disclosures

The Service collects certain sensitive information on a voluntary basis, including:

  • STD/STI status - self-reported and unverified.
  • Food allergies and dietary restrictions - for date planning compatibility.
  • Intimate preferences (kink questionnaires) - restricted to designated 18+ features.
  • Financial comfort level - approximate self-assessment, not verified income.

We do not verify any health claims. You should not rely on another user's health disclosures for medical decisions. We are not a healthcare provider and offer no medical advice. You are encouraged to have direct conversations with potential partners and consult healthcare professionals regarding any health concerns.

By sharing health or sensitive information, you acknowledge that matched users may see this information as described in your privacy settings, and you do so at your own risk.

Legal Disclosure Notice: Health information you disclose on ZMetcha (including STD/STI status) may be discoverable in legal proceedings if compelled by court order or subpoena. In some jurisdictions, certain health-related disclosures may carry legal implications. Users are responsible for understanding applicable laws and exercising discretion when sharing sensitive information. We encourage you to consult legal counsel if you have questions about your disclosure obligations.

7. Messaging

Messaging is available between mutually matched users. We may monitor messages using automated tools and human review for safety purposes, including detecting harassment, threats, CSAM, and other prohibited content. We do not guarantee message delivery, storage, or availability. Messages may be retained for a limited period after account deletion for safety and legal compliance purposes.

8. DMCA and Copyright

We respect intellectual property rights and respond to valid DMCA takedown notices. If you believe your copyrighted work has been used on our Service without authorization, please send a notice containing:

  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is claimed to be infringing, with sufficient detail to locate it.
  • Your contact information (name, address, phone, email).
  • A statement that you have a good-faith belief that the use is not authorized.
  • A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner.
  • Your physical or electronic signature.

Users who repeatedly infringe copyright will have their accounts terminated.

9. Disclaimers and Assumption of Risk

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9a. No Guarantee of Matches or Outcomes

WE DO NOT GUARANTEE compatibility, behavioral outcomes, or the accuracy of any insights generated by the Service. You will not receive guaranteed matches, and matches may not be compatible. No interaction is guaranteed to lead to a friendship, relationship, or any other desired outcome. Compatibility scores are algorithmic estimates based on self-reported data and do not predict real-world compatibility. Insights derived from quizzes and questionnaires are generated through automated systems and are not intended to be scientifically accurate, diagnostic, or predictive of real-world behavior. Users should not rely on any compatibility scores, personality insights, or other outputs of the Service for real-world decision-making. The Service does not provide medical, psychological, or professional advice. We do not verify the accuracy of users' self-reported information (including but not limited to relationship intent, health disclosures, financial status, and personality questionnaire responses).

Match refinement and data completeness. Match percentages reflect how much compatibility data has been shared by both users. Users who have completed fewer quizzes or profile sections receive approximate "early" matches, and the displayed percentage refines as additional data accumulates. A match confidence indicator (Low, Medium, or High) accompanies every match percentage so users can interpret the underlying data coverage. Match percentages are therefore approximate by design and may change over time as either user updates their profile or completes additional questionnaires.

Propagation timing. Changes a user makes to their quiz answers, partner preferences, or profile are reflected in match scoring over time rather than instantaneously. Updates generally reach new (unmatched) candidate calculations within several hours, and updates reach the match calculations seen by users with whom you have already matched within several days. This design is intentional: it protects users against the possibility of other users reverse-engineering their preferences through rapid, targeted edits, and it prevents sudden changes in the compatibility score displayed to an existing match. The exact propagation windows may be adjusted by us over time without prior notice.

Approximate displayed values and rate limits. To further protect each user's data from being probed or reverse-engineered, the displayed match and confidence percentages are intentionally approximate (rounded and subject to small, consistent variation per user or match pair within a stable range). In addition, the Service limits how many quiz and partner-preference edits a user may make in a given time window. These measures are privacy and safety features, not errors, and do not indicate any inaccuracy in the underlying scoring.

No guarantee of outcome. For the avoidance of doubt, no match percentage, confidence indicator, or other output of the Service is a guarantee that any match will result in a successful interaction, relationship, friendship, or any other outcome. All compatibility values are informational only. We do not guarantee that our matching system produces better short-term or long-term outcomes than other methods of meeting people, and you should not rely on any output of the Service as a substitute for your own judgment.

9b. Offline Interactions

ZMETCHA IS AN ONLINE PLATFORM ONLY. WE ARE NOT RESPONSIBLE FOR ANY INTERACTIONS THAT OCCUR OFFLINE. You acknowledge that meeting other users in person involves inherent risks, including but not limited to risks of physical harm, emotional distress, property damage, fraud, theft, sexual assault, or other criminal activity. You assume all risks associated with meeting other users, whether online or in person.

We strongly encourage all users to: meet in public places; inform a trusted friend or family member of your plans (including the person's name, meeting location, and expected return time); arrange your own transportation; and trust your instincts - if something feels wrong, leave immediately.

9c. General Disclaimers

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free.
  • The Service will be free from harmful or inappropriate behavior by other users.
  • Our verification processes will prevent all fraud, misrepresentation, or criminal activity.
  • Other users' profiles, photos, or disclosures are accurate or truthful.
  • Any user is who they claim to be, regardless of verification status.

Users should not rely on the platform, any verification features, or any other users for personal safety decisions. We may modify, suspend, or discontinue any feature of the Service at any time, including safety or verification features, without prior notice.

You are solely responsible for your interactions with other users, both online and offline. We do not conduct criminal background checks on users and make no representations or warranties as to the conduct, character, identity, or intentions of any user. Even if a user has been "verified," this only confirms that their selfie matches their profile photos and their ID document was readable - it does not guarantee their identity, character, criminal history, or truthfulness.

9d. Section 230 - Interactive Computer Service

ZMetcha is a provider of an interactive computer service under 47 U.S.C. § 230. We are not the publisher or speaker of any user-generated content, including but not limited to profiles, bios, photos, messages, health disclosures, or questionnaire responses. We are not obligated to monitor user content but reserve the right to do so. We do not pre-screen all user-generated content and are not liable for content created, shared, or transmitted by users.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PERSONAL INJURY, OR EMOTIONAL DISTRESS ARISING FROM YOUR USE OF THE SERVICE.

Nothing in these Terms excludes or limits our liability for fraud, willful misconduct, or death or bodily injury caused by our negligence, to the extent such exclusion is prohibited by applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless ZMETCHA LLC, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from: your use of the Service, your content, your violation of these Terms, or your violation of any third party's rights.

12. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND HAVE A JURY TRIAL.

12a. Informal Resolution

Before filing any formal dispute, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 60 days.

12b. Binding Arbitration

If the dispute cannot be resolved informally, it shall be resolved through binding individual arbitrationadministered by National Arbitration and Mediation (NAM) under its applicable rules. The arbitration shall take place in Maricopa County, Arizona, or at a location mutually agreed upon, or via videoconference.

12c. Class Action Waiver

YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate proceedings or preside over any form of representative or class action.

12d. Jury Trial Waiver

YOU AND THE COMPANY HEREBY WAIVE ANY RIGHT TO A JURY TRIAL in connection with any dispute arising from these Terms or the Service.

12e. Opt-Out

You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of creating your account. Your notice must include your name, account username, and a clear statement that you wish to opt out of arbitration.

12f. Exceptions

Either party may bring claims in small claims court. Claims relating to sexual harassment or sexual assault are exempt from mandatory arbitration, as required by federal law.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law provisions. For any disputes not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona. The Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions.

14. Termination and Account Actions

You may delete your account at any time through the app settings. We reserve the right, at our sole and absolute discretion, to suspend, restrict, or permanently terminate any account at any time, for any reason or no reason, with or without notice. This includes but is not limited to accounts suspected of fraud, harassment, scamming, impersonation, or any other conduct we deem harmful to the community.

Enforcement actions may be taken automatically or without prior notice, including based on user reports or internal safety systems. We may use automated systems to detect and respond to potential violations, which may result in immediate account restrictions or termination without prior human review. All enforcement and reinstatement decisions are made at our sole discretion and may be based on factors not disclosed publicly.

Upon termination:

  • Your right to use the Service ceases immediately.
  • We may retain certain data as described in our Privacy Policy.
  • No refunds will be issued for unused subscription time, except as required by law.
  • Sections 4, 10, 11, 12, 13, and 14 survive termination.

14a. Automated Safety Systems

We use automated systems, including internal risk scoring and behavioral analysis, to evaluate user activity, detect potential violations, and enforce our policies. These systems may consider factors such as user reports, account history, verification status, and platform behavior. These systems may influence account visibility, access to features, or enforcement actions, and may result in account restrictions, reduced visibility, suspension, or termination without prior human review.

User reports may be used as part of our enforcement processes but are not independently verified and may not reflect actual violations. We do not disclose internal safety assessments, risk scores, or enforcement criteria to users.

14b. Account Review and Reinstatement

In some cases, users whose accounts have been suspended or terminated may request a review of the action taken. Reinstatement is not guaranteed and is granted at our sole discretion on a case-by-case basis. Submission of a reinstatement request or payment of any associated fee does not guarantee account restoration.

  • A non-refundable review fee may apply. This fee covers the cost of manual review and does not guarantee reinstatement.
  • Review eligibility is subject to a waiting period determined by the nature of the violation.
  • As part of any reinstatement process, users may be required to acknowledge prior violations and agree to comply with our policies as a condition of continued access. This acknowledgment is contractually binding.
  • Reinstated accounts may be subject to probationary restrictions, including reduced visibility, increased monitoring, and stricter enforcement thresholds for a defined period.
  • New identity verification (selfie and/or ID) may be required upon reinstatement.
  • A subsequent violation during or after probation may result in escalated enforcement, up to and including permanent termination with no further review eligibility.
  • Certain violations are not eligible for reinstatement under any circumstances, including but not limited to: child sexual abuse material (CSAM), credible threats of violence, stalking, sexual exploitation, and other offenses we determine pose an ongoing safety risk.

The person who originally reported the violation will never be shown the reinstated user's profile, regardless of reinstatement status. This permanent separation is automatic and cannot be overridden.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email and/or in-app notification at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance. If you do not agree, you must stop using the Service and delete your account.

16. Miscellaneous

  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
  • Entire Agreement: These Terms, together with the Privacy Policy and Community Guidelines, constitute the entire agreement between you and us.
  • No Waiver: Our failure to enforce any provision does not constitute a waiver of that provision.
  • Assignment: We may assign our rights under these Terms. You may not assign yours.
  • Force Majeure: We are not liable for failures caused by events beyond our reasonable control.
  • Accounts are non-transferable and terminate upon the account holder's death.

17. Recent Feature Additions (Audit Log)

For attorney review and user transparency, the table below summarizes feature additions that changed the scope of these Terms or the Privacy Policy. Each entry references the Terms section that covers the feature; consult the corresponding section for the binding language.

  • 2026-04-26 (v6). Added §5f Search and Findability (per-channel opt-out toggles for name/phone/email lookup), §5g Prompts and Public Responses (Prompt of the Day public visibility, deletion, retention), and §5h Relationship Tracker (user-side milestone log; one-sided deletion semantics; no partner notification on auto-emit).
  • 2026-04-24 (v5). Phone Verification & SMS Communications (§2a) consent language refreshed for Telnyx 10DLC Mixed-use-case campaign resubmission. Daily prompt functionality referenced in §3 conduct rules.
  • 2026-04-16 (v4). Biometric Data Notice (§2b) clarified to cover sybil dedup, FaceEmbedding 128-float vector storage, and per-state opt-in flow (Illinois, Texas, Washington). Match scoring anti-probing safeguards and propagation timing added to §9c.
  • 2026-04-27 (v7). §5i Safe Meetup -- scheduled in-person check-in feature with optional emergency-contact escalation, double-opt-in SMS for the contact, manual web check-ins, geofence-based arrival detection on the future mobile app, calendar export (Google / Apple / Outlook / .ics), and auto-emit into the Relationship Tracker on completed dates.
  • 2026-04-27 (v7). §2c Background Check substantive update -- moved from "future feature" stub to live opt-in. Voluntary, paid, FCRA-compliant third-party check with 12-month Verified Background badge. ZMetcha stores pass/fail + admin summary only; detailed criminal history stays at provider.
